SEO: There is no magic wand

The Attorney General of Washington State just sued a Search Engine Optimization company.

According to the press release, the lawsuit accuses the SEO company of the following:

· Failing to register with the Department of Licensing as a commercial telephone solicitor and failing to provide written confirmation of a consumer’s rights under the Commercial Telephone Solicitation Act.

· Misrepresenting the ability to significantly increase traffic to customer Web sites by achieving top search-engine rankings and failing to deliver other promised services.

· Falsely claiming an affiliation with other marketers including Specialty Merchandise Company, a so-called drop-ship wholesaler.

· Claiming that its customer service representatives can be reached at any time when, in fact, customers are often unable to reach representatives and sometimes do not receive return calls.

· Failing to provide refunds or honor cancellation requests.

· Continuing to bill the credit cards of some consumers who have attempted to cancel and submitting alleged debts to collection agencies.

Any and all of these instances render the suit by Washington State as completely justified, as far as we are concerned. It seems that this is just another company that gets into the SEO business and then simply sits around and collects checks. It doesn’t take long for their clients to figure out that they have purchased nothing more than a bill of goods.

At Foster Web Marketing, we actually believe it to be a good thing when a disreputable SEO company either goes under or, as demonstrated above, faces legal action for being a “rainmaker.” This is when so called “experts” charge for services that they claim will change something that they have no control over, which they claim credit for if it happens to change, or demand more money if it doesn’t.

These companies absolutely ruin the reputations of others that do things the right way. As a company that mainly works with personal injury attorneys, we as well as our clients are acutely sensitive to those who engage in practices that diminish our profession.

Beware of the Word “Proprietary”: There is no “secret formula” when it comes to search engine optimization work. Everybody involved knows that it involves repetition, smart placement of keywords, linking and constant updates. Anyone claiming that there is anything else involved is either selling you a bill of goods or is someone who doesn’t know that they are talking about. Any company that is either unwilling or unable to tell you exactly what they do without using overly technical jargon should be avoided at all costs.

Beware of “Guarantees”: There is not a reputable attorney anywhere in America who would “guarantee” a satisfactory judgment or verdict for their clients. Our legal system isn’t anything that can be “guaranteed.” The outcome is based on the competence of the attorneys, the evidence involved, and the opinions and verdicts of judges and juries. Search engines are just as nebulous and changing as verdicts in court. A successful outcome would most certainly be a number one spot on Google, but there is no guarantee that you will get there. Not only are you trying to work within the search engine protocols, but you are also working against all of your competitors, each of whom would like to occupy the top spot themselves. There simply ARE no guarantees in the Search Engine Optimization business.
